Even with an individuals first offense there are possible jail time or considerable probation time prearranged with significant coverage and contact with a probation officer. Second offenses are roughly reserved as felonies due to these crimes characteristically cause considerable bodily injury and psychological pressure towards the victim.

Usually if the victim had in fact made contact from the individual committing the offense it would then result in a battery charge.
